Nursing Home Ombudsman Program

The Long Term Care Ombudsman Program was established by the federal government in 1973. Massachusetts was among the first six pilot projects. Begun as a demonstration program, the Ombudsman Program today exists in all states, the District of Columbia, Puerto Rico and Guam, under the authorization of the Older Americans Act. Each state has an Office of the State Long-Term Care Ombudsman, headed by a full-time state ombudsman. The statewide programs are federally funded under Titles III and VII of the Act and other federal, state and local sources.

The Ombudsman Program has 4 main goals.

The Long-Term Care Ombudsman Program within Elder Services of Berkshire County oversees the 15 nursing homes (Berkshire Place is partially a Rest Home) in the county.  There are state certified volunteers and two paid staff, all of whom provide weekly visits to their assigned homes.  The visits entail checking on residents, identifying concerns, and attempting to empower residents to advocate on their own behalf or investigating a resident’s concerns by working with the home for a resolution in a fair and reasonable manner.


Complaint records, inquiries, or investigations are confidential and not subject to disclosure outside the Ombudsman Program’s office.   An ombudsman does not reveal the identity of a complainant, or bring a concern forward, without the person’s express consent. 


Some of the reasons to contact the Ombudsman Program would be… if you are concerned about the care or treatment in a nursing or rest home; are looking for information regarding resident rights; need guidance in selecting a long term care facility; or have a question about a transfer or discharge of a resident.
